The authorities responsible for cultural heritage in the summer of this year have documented a case of unauthorized works in the protection zone of the Historical Center of Prizren. This case has been further addressed to the competent bodies, and based on the answers received by EC Ma Ndryshe from various institutions, the matter in question has not yet received an epilogue, while the construction works have continued.

QRTK in Prizren has announced that it has not received any official request for the demolition or the start of construction of buildings on "Fehmi Lladrovci" street, and that beyond that it has noticed that works have been undertaken without consent of this center within the surface of the protection zone of QHP. According to the announcement of the QRTK, this violation has been documented and reported to the Inspectorate of Cultural Heritage and to the Inspectorate of the Municipality of Prizren.

But the Municipality of Prizren had a different interpretation for this area. From the officials of the DUPH of the Municipality of Prizren, EC has requested information on whether a permit was issued for the demolition of the existing buildings on "Fehmi Lladrovci" street, and whether a construction permit was issued after consultations with the QRTK. "The location is not part of the Historical Center and in a diameter of 50m there are no objects with a temporarily protected status. Permission was granted for demolition as the buildings have no historical value", says the response of the DUPH.

Meanwhile, the Inspectorate of Cultural Heritage has informed that after the announcement of the QRTK, in August of this year, the inspectors went to the field and found that the construction in this space has started based on the permit issued by the Directorate of Urbanization and Spatial Planning of the Municipality of Prizren. ITK after analyzing this construction permit has found that the construction was allowed without conditions and criteria as well as without approval from the competent institutions of cultural heritage, bypassing the rules defined by the Law on the Historical Center and the Management Plan of this center. ITK has emphasized that it attacked the construction permit issued with legal objections with a complaint to the MMPHI, requesting the annulment of this decision and the return in reinstatement according to the legislation in force.

The Office for Information of the MMPHI announced that after the request of EC, in November of this year, it sought clarification from the Municipality of Prizren if the DUPH has received a complaint from MKRS, and that the DUPH has emphasized that it has not accepted any request of this nature. Based on this answer, MMPHI has asserted that in accordance with the legislation on administrative procedures, the complaint has been sent to the municipal body for decision with an administrative act on this matter.

EC considers that in such cases, especially those related to the historical area, the Municipality of Prizren should not lean towards unilateral interpretations and that it should coordinate with the competent bodies of cultural heritage, as for respecting the provisions of the Law on the Historical Center as well as for the implementation of the Management Plan, in order to preserve the protection of values ​​in this protected area.
