Dismissal of officers charged with abuse of official duty required
The Mayor of Prizren, Mr. Mytaher Haskuka, on February 13, 2020, at a press conference and posting on his Facebook page, informed the public that the coalition with LDK makes no sense to continue because of conditionalities and at the same time has thanked the directors and vice mayors from LDK for their cooperation and commitment in achieving local government priorities. In case of implementation of this position of the Mayor, the Director of DWSW, who comes from the LDK, is dismissed and is accused by the Prosecution of committing the criminal offense of "Abuse of Official Position or Authority". In such a situation, only two VV directors with separate indictments for abuse of official position or authority remain in office. EC recalls that: The Basic Prosecution in Prizren on 3 December 2019 announced that it had filed an indictment against three municipal directors and two other persons on the grounded suspicion that they had committed the offense of "Abuse of Official Position or Authority" by Article 422, paragraph 1 in conjunction with paragraph 2, point 2.6 in conjunction with Article 31 of the Criminal Code of the Republic of Kosovo.
On 20 December 2019, the Basic Prosecution in Prizren announced that it had filed an indictment against a director and five other municipal officials, on the grounded suspicion that they had committed, in co-perpetration, the offense of "Abuse of Official Position or Authority" by Article 414 paragraph 2-1 regarding Article 31 of the Criminal Code of the Republic of Kosovo (CCRK). On 14 January 2020, the Mayor of Prizren, Mr. Mytaher Haskuka has announced that the Director of Geodesy and Cadaster, Refik Shaqiri (one of the three directors indicted on 3 December 2019) has resigned and will continue his career in the public health system.
Considering the hitherto lack of individual will of other municipal directors who have indictments to reflect on the resignation of the director of the municipal directorate, EC Ma Ndryshe, reiterates the request to the Mayor of Prizren, Mr. Mytaher Haskuka for taking concrete action to dismiss his subordinates suspected of violating the law. EC recalls that Mr Haskuka's election promises were in setting standards for such cases and maintaining institutional credibility. The request to dismiss directors with indictments was addressed in December 2019 by NGOs: EC Ma Ndryshe, Cultural Heritage Foundation - Legatum, Democratic Institute of Kosovo (KDI), IPSIA, THY and X40; and it was repeated in January 2020 by EC Ma Ndryshe.
